If your laser
printer/copier service person says:
"I’ll
have to void your warranty if you don’t use an original toner/OPC
cartridge."
or
"Using a recycled or remanufactured toner cartridge will void
your warranty."
or
(your
printer is still under warranty and he/she says:)
"You’ll
be charged for this service call since you’re not using our cartridge."
DON’T
BE INTIMIDATED!
IT
IS ILLEGAL for your laser printer/copier manufacturer
to require you to use or purchase a particular brand of cartridge,
just as it is illegal for your car dealer to require only original
parts be used to fix your car. An Original Equipment Manufacturer
(OEM) cannot void your warranty simply because you exercise your
right to choose your preferred brand of supplies. To enforce such
a policy is in direct violation of the Sherman & Clayton Antitrust
Acts.
IBM
vs. The United States, a case brought before the U.S.
Supreme Court, set the precedent. The high court ruled that companies
which engage in the practice of requiring or intimidating their
customers into purchasing supplies or replacement parts from them
exclusively create a "tying agreement" which was found to be in
violation of Antitrust Laws.
Hewlett
Packard clearly states in their warranty policy that
"Hewlett Packard does not prohibit the use of refilled toner cartridges
during the warranty period or under a maintenance contract..."
DON’T
BE AFRAID to show this information to any service person
or OEM representative who inhibits or threatens your right to
choose your own cartridge supplier. Should a service person or
OEM representative try to tell you your warranty will be voided,
etc., etc., simply ask him/her that you would like them to
state that in writing on their company letterhead and that you
want them to be sure to date and sign the letter.It is very
unlikely that you will get the written statement you request.
